This Terms of Service ("Terms") outlines the rules and conditions for using our application, Wisp ("App"). By accessing or using the App, you agree to be bound by these Terms. Please read them carefully before using the App.
These Terms constitute a legally binding contract between you and Wisp. If you disagree with any provision, you must not use the Service.
No account may be created by anyone under sixteen years of age. We may request proof of age and will close any account that fails verification.
By proceeding you separately authorize the arbitration clause required by NRS 597.995, found in § 20.
Wisp is a chat-and-media playground powered entirely by large-language and generative-media models. While using it you may interact with AI companions, consisting of pre-authored and continuously auto-generated fictional profiles complete with voices, back-stories, and selfies. Every prompt you send steers the AI and can radically change subsequent output. By creating or uploading a character you represent that you possess all required rights and consents. All output—text, images, voice, or video—is referred to as "AI Content."
Any face that smiles in a "selfie," any voice that flirts in an audio note, or any anecdote a character recounts is a machine fabrication. Resemblance to real persons or events is coincidental and does not imply participation or endorsement.
Wisp's AI is lightly filtered and permissive toward not-safe-for-work material, meaning you may encounter profanity, sexual themes (including kink or fantasy scenarios), violent descriptions, or strong political opinions. For users under eighteen we employ a "harmful-to-minors" screen that blurs explicit images and requires an additional click to view them. You acknowledge and accept the residual risk.
AI Content may be outdated, biased, plagiarized, nonsensical, or incorrect. It must not be treated as fact, instruction, counseling, or advice and must never be relied upon for medical, legal, financial, safety-critical, or identity decisions.
Interacting with a Wisp character does not create any doctor–patient, therapist–client, attorney–client, fiduciary, or employment relationship; any perceived emotional support or guidance is fictional role-play only.
Prompt wisely because what you ask determines what you receive. If you repost AI Content, you must clearly indicate that it is synthetic and, where applicable, not safe for work. Use the in-app Report function to flag material that violates § 6; we reserve, but do not assume, the right to block or blur content at our sole discretion.
Although we apply automated and manual checks, no filter is perfect. By continuing, you agree that inappropriate, offensive, or erroneous AI Content may appear and that Wisp's liability is limited as set out in § 14.
Bottom line: Everything you see, read, or hear in Wisp is machine-made fiction—sometimes explicit, often unpredictable, always your responsibility to interpret.
Wisp is not a medical, psychological, legal, or financial service. If you experience an emergency or believe you may harm yourself or others, stop using Wisp and call emergency services (for example, 911 in the United States) immediately. We do not monitor users in real time.

You must provide accurate registration data and keep your credentials secure. You are responsible for all activity on your account and should report breaches to . We may reclaim usernames or suspend, delete, or disable accounts for violations or prolonged inactivity.
Wisp offers a free tier and Wisp Plus. Wisp Plus becomes mandatory once you exhaust free allotments of swipes, messages, retries, and super-matches, or you may voluntarily upgrade from your profile. Wisp Plus currently includes unlimited swipes, five Super Matches each week, unlimited retries, access to your entire message history, and unlimited messages.
Subscriptions are sold through the Apple App Store or Google Play (collectively, the "Marketplace") and auto-renew unless you cancel through the Marketplace at least twenty-four hours before the current period ends.
We may change prices at any time. New prices take effect at the next billing cycle after at least thirty calendar days' prior notice by e-mail or in-app banner. If you disagree, cancel before the change becomes effective; your subscription will continue at the old price until the end of the current billing period.
All sales are final except to the extent a Marketplace, or mandatory local law, provides otherwise. Refund requests must be submitted through the Marketplace's own tools.
"Selfies" and other in-app items are licensed, not sold, carry no cash value, and may be modified or removed without compensation.
You agree not to upload, solicit, or distribute illegal, defamatory, harassing, violent, hateful, deceptive, or sexually exploitative material (including any depiction of minors); to violate intellectual-property, privacy, or publicity rights; to rely on Wisp for professional, emergency, or life-critical decisions; to reverse-engineer, probe, scrape, or interfere with Wisp or its APIs; to introduce malware, spam, phishing, or pyramid schemes; to harvest data, perform facial recognition, or build profiles without consent; to use Wisp if you are subject to U.S. or other applicable sanctions; to circumvent age-gating, regional blocks, or moderation controls; or to employ Wisp for political campaigning or commercial advertising without our written consent.
You may report any message via the in-app Report function. Reported material may be removed, chats cleared, and accounts suspended or terminated at our sole discretion. We do not disclose our review criteria or timelines.
You retain ownership of everything you submit, but you grant Wisp and its affiliates an irrevocable, perpetual, worldwide, royalty-free, fully-paid, transferable, and sublicensable licence to use, host, store, reproduce, modify, adapt, create derivative works from, publish, perform, display, and distribute that content now and in the future, in any media, for any purpose, without compensation. This licence survives account deletion. Nothing in this licence overrides non-waivable rights under privacy or data-protection laws; where legislation (for example, GDPR Article 17) requires deletion of specific personal data, Wisp will comply even if that conflicts with the survival language above.
All AI-generated content is owned by Wisp. We grant you a personal, non-exclusive, non-transferable, revocable licence to view and share that content for non-commercial purposes, subject to these Terms; any commercial use requires our prior written consent.
If you upload or request a likeness, you affirm that you have all necessary rights and that our use will not infringe anyone's privacy, publicity, or intellectual-property rights.
Ideas, suggestions, and other feedback you provide become Wisp's property, and we may use them without notice or compensation.
All Wisp trademarks, the interface, proprietary orchestration code, workflow logic, and our fine-tuned or custom-built AI models are the exclusive property of 21ST Q Ltd. We combine those assets with third-party foundation models and datasets that remain the property of their respective owners. Except for the limited licences expressly granted in § 8, you obtain no rights in any Wisp IP or third-party technologies. All worldwide rights not expressly granted are reserved.

Links to third-party sites or services are provided "as is." We do not endorse or control them and have no responsibility for any damage or loss they cause.
Your personal data is processed as described in our Privacy Policy. By using Wisp you consent to such processing, including transfer to and storage in the United States, regardless of your location.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. YOUR USE IS AT YOUR SOLE RISK.
In no event will Wisp's total aggregate liability, whether in contract, tort (including negligence), or otherwise, exceed the greater of one hundred U.S. dollars or the fees you paid to Wisp during the six months immediately preceding the event giving rise to the claim. This cap does not apply to liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence.
You will defend, indemnify, and hold harmless Wisp, its affiliates, officers, directors, employees, and agents from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your content, your violation of these Terms or any law, or your misuse of the Service.
We may impose storage or bandwidth limits and may delete or purge any data or asset—including individual messages, media files, character profiles, conversation histories, or entire accounts—at any time, for any reason, with or without prior notice. You should back up anything you wish to retain.
You may not use, export, or re-export Wisp except as authorized by U.S. law and the laws of the jurisdiction in which the Service was obtained.
We are not liable for any failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, labour disputes, or utility failures.
We continually improve Wisp, and the legal fine print may evolve. When we update these Terms or introduce a material price change we will provide at least thirty calendar days' advance notice by e-mail or a prominent in-app banner. The revised Terms or new pricing take effect on the date stated in the notice, and your continued use after that date constitutes acceptance. If you live in the European Union and object to a material change, you may cancel your subscription without penalty by e-mailing before the change becomes effective; we will refund any prepaid fees on a pro-rata basis for the unused period. We also reserve the right to add, modify, or retire features and content at any time.
These Terms are governed by Nevada law without regard to conflict-of-laws principles.
Before commencing arbitration, you and Wisp must each e-mail a written Notice of Dispute to that describes the claim and the relief sought, then attempt in good faith to resolve the dispute for sixty calendar days.
Unresolved disputes will be finally and exclusively settled by binding arbitration before a single arbitrator of the American Arbitration Association under its Consumer Arbitration Rules, with the seat in Clark County, Nevada. Hearings may be remote at your request.
Either party may bring an individual claim in small-claims court for amounts of ten thousand U.S. dollars or less in a court of competent jurisdiction in Clark County, Nevada.
YOU AND WISP WAIVE any right to a jury trial or to participate in a class or representative action.
Each party bears its own AAA filing, administrative, and arbitrator fees and its own legal costs. The arbitrator may not award damages, costs, or fees exceeding the cap in § 14.
Arbitration proceedings, filings, and awards are confidential except as necessary to enforce or challenge the award or as required by law.
If any portion of this § 20 is invalid or unenforceable, the remainder remains in force.
Send copyright notices that satisfy 17 U.S.C. § 512(c)(3) to with the subject "DMCA." Repeat infringers will be terminated.
These Terms, together with the Privacy Policy and any applicable Marketplace terms, constitute the entire agreement between you and Wisp. You may not assign any rights or obligations hereunder; Wisp may assign freely in connection with a merger, sale, or reorganization. If any provision is unenforceable, the remainder remains effective. Failure to enforce any provision is not a waiver of future enforcement. Sections 2 through 8, 11 through 18, and 20 through 22 survive account deletion. Apple Inc., Google LLC, and their respective subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon acceptance.
